Selective Licensing

What is Selective Licensing? This is a local authority scheme that requires private landlords to obtain a licence for each rented property in a designated area. It aims to raise housing standards, reduce antisocial behaviour and improve neighbourhoods while making landlords more accountable and professional. 

Selective Licensing is a statutory licensing regime introduced under the Housing Act 2004 that allows a local housing authority to designate an area where every privately rented home (except specified exemptions) must hold a licence. Unlike HMO licensing, which targets shared-house occupancies, selective licensing can apply to single-let homes as well as HMOs inside the designated boundary.

Local authorities use selective licensing to tackle concentrated problems such as low housing demand, high crime or persistent antisocial behaviour, and poor property conditions; licensing gives councils inspection and enforcement powers to improve outcomes for tenants and neighbours. By ensuring licensed properties meet safety and management standards, selective licensing helps stabilise communities, make areas more attractive to tenants and buyers, and reduce long-term costs linked to empty or poorly managed homes. 

If your property falls inside a designated selective-licensing area you are legally required to apply for and hold a licence; failing to do so is a criminal offence and can lead to substantial penalties, Rent Repayment Orders, banning orders and even management orders in serious cases. Non-compliance may also breach mortgage or insurance conditions, leaving you financially exposed, so proactively checking your council’s designated areas is essential.
